Terms of Service

1. Acceptance
By creating an account or paying for a backup, you agree to these terms. If you don't agree, don't use the service.
2. What Podokai does
Podokai downloads the episodes of a podcast you point us to, stores them on object storage, and gives you back a portable archive plus, if you subscribe, a mirror RSS feed kept in sync with the source.
We are not a podcast host or a streaming platform. We are a backup service.
3. Who can use it
You may only back up podcasts that you own or for which you have the explicit permission of the rights holder. Submitting a feed implies that you have that right. You are responsible for any infringement claims arising from feeds you submit.
4. Pricing & billing
- One-shot backup ($9.90): a single download of your podcast, accessible for 90 days.
- Continuous mirroring ($29.90/year per podcast): automatic sync every 6 hours and a permanent mirror feed, billed yearly until you cancel.
- Payments are processed by Stripe. Prices are in USD and exclude any local taxes you may owe.
5. Refunds
If a backup job fails because of an error on our side, we'll refund you automatically. If you want a refund for any other reason, email hello@podokai.com within 14 days of the charge and we'll make it right.
EU consumers have a statutory 14-day right of withdrawal. By starting a backup immediately after payment, you accept that the service is rendered before the 14 days elapse, which waives that right under EU consumer law for the consumed portion.
6. Subscription cancellation
You can cancel a continuous subscription anytime via the billing portal from your dashboard. Cancellation takes effect at the end of the current billing period. Your mirror feed and stored files stay available for 30 days after cancellation, then are purged.
7. Acceptable use
Don't use the service to back up content you don't have rights to, to relay malware, to host content that's illegal in France or in your jurisdiction, or to overload the service. We may suspend or terminate accounts that violate this.
8. Service availability & data loss
We aim for high availability and durable storage, but we make no warranty that the service or your archives will be uninterrupted or error-free. Podokai is insurance against your podcast host disappearing — it is not a substitute for your own backups. Keep an independent copy of anything you can't afford to lose.
9. Limitation of liability
To the maximum extent permitted by law, our total liability for any claim related to the service is capped at the amount you paid us in the 12 months preceding the claim. We are not liable for indirect or consequential damages.
10. Termination
You can delete your account anytime from your dashboard. We may terminate or suspend the service if you violate these terms, with notice unless the breach is severe.
11. Changes
If we change these terms, the "Last updated" date will change at the top. For material changes, we'll email registered users. Continued use after changes constitutes acceptance.
12. Governing law
These terms are governed by French law. Disputes that can't be resolved amicably are subject to the exclusive jurisdiction of French courts, subject to mandatory provisions for EU consumers.
